READ RULING: Judge Refuses To Dismiss Bruno Case

A federal judge today rejected an attempt by former Senate Majority Leader Joseph Bruno to dismiss the latest corruption charges brought against him.

[1]After his original convictions were thrown out of court in 2009, prosecutors in May charged the 83-year-old Bruno with a new federal indictment.

In October, Bruno sought to have the case dismissed [2], citing the earlier U.S. Supreme Court decision that tossed part of the “honest services” statute that Bruno was found guilty of violating.

Bruno, a Republican from Brunswick, Rensselaer County, was found guilty of two charges of mail fraud because of dealings he had with Albany-area businessman Jared Abbruzzese, including the sale of a “virtually worthless” horse for $80,000.

An appeals court, however, ruled that Bruno can be re-tried on the charges if prosecutors can prove evidence of a “quid pro quo.”

Judge Gary Sharpe today agreed that the new indictment could move forward because it doesn’t constitute double jeopardy. Bruno’s trial is scheduled for February.

In his ruling, Sharpe said should “Bruno seek to appeal the portion of this decision denying his motion on the basis of double jeopardy, he must do so within 14 days.
