What’s it take for the Department of Environmental Conservation to grab an extra 90 days for its hydrofracking regulations?
The answer, apparently, is eight separate documents, filed yesterday with the state Department of State.
The package of documents are filled with quite a bit of legalese and tend to be a bit difficult to decipher. They are available for your viewing pleasure below.
Included are a number of filings necessary for the extension, including a summary of the proposed regulations’ impacts on the job market and a broad reply to some of the thousands of public comments the DEC has received so far on its hydrofracking review. (We posted the latter document earlier today. )
What’s not included, however, is a set of revised proposals for regulating the gas industry. Those proposals are expected to be released by Dec. 12, when the following documents will be published in the state register .
Meanwhile, environmental groups and other fracking critics are taking issue with the Cuomo administration’s decision to apply for the 90-day extension  rather than starting the rule-making process over. Specifically, they want the DEC to hold off on issuing any new regulatory proposals until a much-anticipated review from academic health experts is completed .
“The Governor was faced with a choice: He could rush to meet an arbitrary technical deadline or allow medical experts the time they need to better protect public health from fracking,” said Deborah Goldberg, managing attorney for Earthjustice. “He made the wrong choice.”
