Schneiderman Hits 13 Gas Stations With Price Gouging

Thirteen gas stations in the New York City area, including three in Westchester County, are being accused of price gouging during Superstorm Sandy, Attorney General Eric Schneiderman charged today.

[1]Schneiderman’s office has received more than 700 complaints from customers who said gas prices were artificially inflated during the storm, when the New York City area had a scarcity of fuel.

New York City, as well as Long Island, Rockland County and Yonkers, implemented gas rationing after the storm because distribution lines were disrupted. It let to long lines and closed stations.

“Our office has zero tolerance for price gouging, and we are taking action to send a message that ripping off New Yorkers is against the law,” Schneiderman said in a statement. “Today’s action is the first in a series of steps my office will take as we continue to actively investigate the hundreds of complaints we’ve received from consumers of businesses preying on victims of Hurricane Sandy.”

The move puts the gas stations on notice that there will either be a lawsuit or an attempt at a settlement with the state.

The three Westchester County gas stations cited in Schneiderman’s probe were Shell at 3709 Crompond Road, Cortlandt Manor; Mobil, at 174 Westchester Avenue, White Plains and Mobil, at Hutchinson River Parkway, White Plains.

All were charging more than $5 a gallon for gas, Schneiderman alleged. Attempts by Gannett’s Albany Bureau to get comment from the three gas stations were not immediately unsuccessful.

Schneiderman said the state’s Price Gouging Law prohibits merchants from selling goods or services for an “unconscionably excessive price” during an “abnormal disruption of the market.”
