In Albany, Colbert Report Takes on Lap Dance Tax

If there is source material more tailor-made for late-night television fodder, I’ve yet to find it.

The Colbert Report, the popular Comedy Central show featuring faux conservative blowhard Stephen Colbert, traveled to Albany for a piece on Nite Moves, the suburban strip club that sought to have nude dancing classified as art—and therefore making it exempt from state taxes.

The results, unsurprisingly, are pretty funny.

A crew from the show spoke to Nite Moves owner Stephen Dick, who had refused to pay a state tax bill after a state tribunal hit him with $400,000 in back taxes.

Later, they had Steve Barnes, an art and food writer for the Times Union of Albany, review the Nite Moves experience. It’s art, he concluded, but “lousy art.” [1]

The state Court of Appeals disagreed last month [2], citing the difference between “highbrow” and “lowbrow” art in ruling that lap dances are not, in fact, tax exempt.
